Welcome to Nothing Butt. “We”, “us” and “our” refer to Nothing Butt Ltd. We operate this website and store, plus all related content, features, tools, products and services, to provide you with a simple, curated shopping experience (the “Services”). Our store is powered by Shopify.

These Terms of Service (the “Terms”), along with the policies we reference (including our Privacy Policy and Refund Policy), set out your rights and responsibilities when using the Services. By visiting, interacting with, or purchasing from the Services, you agree to these Terms and our Privacy Policy. If you do not agree, please do not use the Services.

1) Access and account

  • You confirm you are at least the age of majority in your country/region of residence.

  • To use the Services you may be asked for information such as your email, billing, payment and shipping details. You warrant this information is accurate, current and complete, and that you have the right to provide it.

  • You are responsible for keeping your account credentials secure and for activity on your account. Do not share or transfer your account.

2) Our products

  • We work hard to show products clearly, but colours and appearance can vary by device and settings.

  • Product details, availability and pricing may change without notice. We may discontinue products or limit quantities to any person, household, region or jurisdiction.

3) Orders

  • When you place an order, you make an offer to buy. We may accept or decline at our discretion. We accept once payment is processed and we send a dispatch confirmation.

  • Please check your order carefully before submitting; we may not be able to cancel after acceptance. If we change or do not accept an order, we will contact you using the details provided.

  • Purchases are for personal or household use and not for commercial resale or export.
    Returns and exchanges are handled under our Refund Policy. Your statutory rights are not affected.

4) Prices, billing and subscriptions

  • Prices, discounts and promotions can change without notice. The price you pay is the price shown at checkout when you place the order, as confirmed in your email. Prices are in GBP and, unless stated, exclude delivery and any applicable taxes/charges.

  • You agree to keep your payment details and contact information up to date so we can complete transactions and get in touch when needed.

  • You confirm you are authorised to use the chosen payment method and that your card provider will honour charges.

  • Subscriptions: You can manage, pause or cancel from your account at any time. We will always email before the next renewal is charged. Specific subscription terms (including any promotional pricing) apply as set out at sign-up.

5) Shipping and delivery

  • We currently use Royal Mail and other trusted carriers. Delivery windows are estimates, not guarantees.

  • Risk in the goods passes to you on delivery to your address (or a person you nominate). Title passes when we receive full payment.

  • Once dispatched, we will send tracking or delivery updates where available.

6) Promotions & discount codes

  • From time to time we run promotions and issue discount codes. Each promotion has its own terms on the offer page, email or ad. If there is a conflict, the promotion terms apply.

  • Unless stated otherwise: one code per order; codes are non-transferable, not redeemable for cash, and apply to product prices before shipping and taxes; stacking is not permitted.

  • Limits may apply (per customer, per product, usage caps, date ranges and time zones).

  • “Lifetime” subscription discounts (for example, an additional 10% off): the discount applies only while your subscription remains active. If you pause, cancel, or allow payment to lapse beyond any grace period, the promotional discount ends. If you restart later, the discount will not resume unless we expressly offer it again.

  • We may change, suspend or withdraw a promotion at any time (for example, to correct errors or prevent misuse). This does not affect codes already redeemed before the change.

7) Intellectual property

  • The Services and all content (including trademarks, text, images, graphics, video, audio and their arrangement) are owned by Nothing Butt Ltd or our licensors and are protected by UK and international intellectual property laws.

  • You may use the Services for personal, non-commercial use only. You must not copy, modify, distribute, display, perform, publish, or create derivative works without our prior written consent.

  • Nothing in these Terms grants you rights in our or Shopify’s intellectual property. All rights are reserved. Our names, logos and product names are trademarks of Nothing Butt Ltd or our affiliates/licensors. Shopify’s names and marks are trademarks of Shopify. Other marks belong to their owners.

8) Optional tools

We may provide access to third-party tools on an “as is” and “as available” basis. We do not control these tools and are not liable for your use of them. Use them at your own discretion and review the third party’s terms.

9) Third-party links

The Services may link to third-party sites or include embedded third-party functionality. We are not responsible for their content, policies or practices. Access and use are at your own risk. Direct any issues to the third party.

10) Relationship with Shopify

Nothing Butt is powered by Shopify, which enables us to provide the Services. However, any sales you make are with Nothing Butt Ltd. Shopify is not responsible for your purchases from us and is released from claims, damages and liabilities arising from your transactions with Nothing Butt.

11) Privacy

Personal information we collect through the Services is handled under our Privacy Policy. Because the Services are hosted by Shopify, Shopify also collects and processes certain data to provide and improve the platform. See our Privacy Policy (and Shopify’s) for details.

12) Feedback and reviews

  • If you submit reviews, ideas or other content (“Feedback”), you grant us a worldwide, perpetual, sublicensable, royalty-free licence to use, reproduce, publish and display that Feedback in any medium for our business purposes.

  • You confirm you own the Feedback or have rights to provide it; you have disclosed any incentives; and your Feedback complies with these Terms and applicable laws.

  • We may monitor, edit or remove Feedback we consider unlawful, offensive or otherwise objectionable, or which infringes rights. You are responsible for your Feedback and its accuracy.

13) Errors, inaccuracies and omissions

Occasionally there may be information on the Services that contains errors or omissions (e.g., product descriptions, pricing, promotions, shipping charges, transit times and availability). We may correct, update or cancel orders where permitted, without prior notice, including after submission.

14) Prohibited uses

You must not use the Services for unlawful, harmful, fraudulent, infringing, harassing or otherwise objectionable activity; to send spam; to scrape or crawl; to upload malware; to bypass security; or to collect others’ personal data. We may suspend or terminate access where we reasonably believe these Terms are breached.

15) Termination

We may suspend or terminate access to the Services at any time. You remain responsible for all amounts due up to the date of termination. Sections that by nature should survive will continue to apply (including Intellectual Property, Feedback, Disclaimers, Limitation of Liability, Indemnification, Governing Law).

16) Disclaimer of warranties

Except as expressly stated by Nothing Butt, the Services and all products are provided on an “as is” and “as available” basis. We do not warrant that the Services will be uninterrupted, timely, secure or error-free, or that information is complete or current. Where your local laws do not allow certain disclaimers, those rights remain.

17) Limitation of liability

To the fullest extent permitted by law, Nothing Butt Ltd and our directors, officers, employees, agents, partners, service providers and licensors will not be liable for: (a) indirect, incidental, special or consequential losses; (b) loss of profits, revenue, savings, data or goodwill; or (c) losses not caused by our breach or that were not reasonably foreseeable. Nothing excludes liability where it would be unlawful to do so (including for death or personal injury caused by negligence, or for fraud).

18) Indemnification

You agree to indemnify and hold harmless Nothing Butt Ltd and our affiliates, officers, employees, agents, partners, licensors and service providers from third-party claims and reasonable legal fees arising from your breach of these Terms, violation of law, or misuse of the Services.

19) Severability

If any part of these Terms is found unlawful or unenforceable, the rest remains in force. The affected provision will apply to the maximum extent permitted by law.

20) Waiver and entire agreement

If we do not enforce a right, it is not a waiver. These Terms and any policies referenced on the site form the entire agreement between you and us about the Services and replace prior agreements on the same subject.

21) Assignment

You may not transfer or assign your rights or obligations under these Terms without our consent. We may assign or transfer our rights and obligations at any time.

22) Governing law and jurisdiction

These Terms are governed by the laws of England and Wales. You and Nothing Butt agree that the courts of England and Wales will have exclusive jurisdiction, except that consumers resident in Scotland or Northern Ireland may bring proceedings in their local courts.

23) Changes to these Terms

You can review the current Terms on this page. We may update them from time to time. We will post changes here and, where required by law, notify you. Your continued use of the Services after changes take effect means you accept the updated Terms.
